1. Agreement to terms
These Terms and Conditions ("Terms") are a legal agreement between you and LogbookScan LLC("we", "us", or "our"), a company operating the Xcelify service. By accessing or using Xcelify, you agree to be bound by these Terms. If you do not agree, you must not use the service.
2. Description of service
Xcelify is an AI-powered document extraction platform that converts tabular paper documents into structured Excel spreadsheets. We provide tools for defining column schemas, scanning documents, verifying extracted data, and exporting results.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account, and keep it up to date.
4. Acceptable use
You agree not to misuse the service. This includes, but is not limited to:
- Using Xcelify for any unlawful purpose or in violation of any applicable law
- Uploading content you do not have the right to use, or that infringes intellectual property rights
- Attempting to interfere with or disrupt the service, servers, or networks
- Using automated systems or software to extract data from the service in an unauthorised manner
- Impersonating another person or misrepresenting your affiliation with any entity
5. Intellectual property
All software, designs, documentation, branding, and other materials provided through Xcelify are owned by LogbookScan LLC or our licensors and are protected by intellectual property laws. You retain ownership of the documents and data you upload, and you grant us a limited licence to host and process that content solely for the purpose of providing the service to you.
6. Payment and billing
Xcelify operates on a pay-as-you-go credit model. You may top up your balance using the payment methods available in your account. Payments are processed securely by Stripe, including support for Stripe Link for faster checkout. By making a purchase, you also agree to Stripe's applicable terms presented at checkout.
All purchases are final. Topped-up balance is non-refundable and never expires. See our Refund Policy for details. Where applicable, sales tax, VAT, or GST will be calculated and added at checkout.
7. Service level
We strive to keep Xcelify available and functioning correctly, but we do not guarantee uninterrupted or error-free service. Scheduled maintenance, updates, or circumstances beyond our control may result in temporary downtime.
8. Termination and suspension
We may suspend or terminate your access to Xcelify at any time, without notice, if we believe you have materially breached these Terms, engaged in fraudulent activity, posed a security risk, or repeatedly violated our acceptable use policies. Upon termination, your right to use the service will immediately cease, and we may delete your account data in accordance with our Privacy Notice.
9. Disclaimer of warranties
Xcelify is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, LogbookScan LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the service. Our total aggregate liability shall be limited to the amount you paid to us in the six months preceding the claim.
11. Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
12. Changes to these terms
We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of Xcelify after changes constitutes acceptance of the revised Terms.
